RESOLUTION NO. 21-2004

     A RESOLUTION OF THE TOWN COMMISSION OF THE TOWN OF
     MANALAPAN, FLORIDA, APPROVING A LIST OF VARIOUS PLANT
     SPECIES WHICH HAVE BEEN DETERMINED BY THE TOWN COMMISSION
     TO BE DETRIMENTAL TO NATIVE PLANTS, ECOSYSTEMS AND HUMAN
     HEALTH, SAFETY AND WELFARE WHICH ARE PROHIBITED FROM BEING 
     PLANTED IN THE TOWN OF MANALAPAN AND WHICH ARE REQUIRED
     TO BE REMOVED BY A TIME CERTAIN; PROVIDING THAT THIS LIST OF
     PROHIBITED PLANT SPECIES SHALL BE AVAILABLE FOR INSPECTION AT
     ALL TIMES AT THE TOWN HALL DURING REGULAR BUSINESS HOURS;
     PROVIDING AN EFFECTIVE DATE; AND FOR OTHER PURPOSES.

     WHEREAS, The Town Commission of the Town of Manalapan, Florida, (the "Town")
desires to adopt a list prohibited plant species which must be removed by various dates in order to
protect the natural vegetation, ecosystem and health, safety and welfare of the citizens of the Town
of Manalapan and for other members of the public; and
     WHEREAS, the Town Commission desires to implement a staggered removal schedule and
establish a time certain for required removal of all species set forth on this list; and 
     WHEREAS, the Town Commission desires to make certain that the prohibited plant species
list and its associated schedule for required removal is available for inspection such that any member
of the public may be aware of the types of prohibited plant species and the deadline for the removal
of same.

     NOW, THEREFORE, BE IT RESOLVED BY THE TOWN COMMISSION OF THE
TOWN OF MANALAPAN, FLORIDA:

     Section 1:     The Town Commission of the Town of Manalapan hereby officially adopts
the following list of prohibited plant species requiring removal as set forth herein. 
     Section 2:     Those trees and plant materials referenced in this section shall constitute a list
of plant species which are prohibited and shall not be planted within the Town and which must be
removed no later than the times listed to the right of each plant species.

     Section 3:     This duly adopted list of prohibited plant species, incorporating time lines for
removal, shall be available at the Town Hall for inspection by the public during normal business
hours.
     Section 4:     This Resolution shall take effect immediately upon adoption.
